Intellectual Property Rights
All content on the site is protected under the applicable copyright and industrial and/or intellectual property laws. By way of example, but not limitation, "site content" is understood to include: • Text • Any graphic and/or textual representation in general • Photographs • Videos. Any reproduction, alteration, transmission, publication and/or redistribution of the site's content is strictly prohibited without the express written authorization of Gold srl, except for printing, downloading and viewing of the site's content carried out for exclusively personal, non-commercial purposes, and provided that the content is not modified in any way and that the information relating to industrial and intellectual property rights affixed to it is retained. Gold srl states that the use of any distinctive signs owned by Gold srl is absolutely prohibited. Likewise, the site's content may not, in whole or in part, be disseminated through communication channels such as the internet, television or radio broadcasting systems, or any other medium, without prior written authorization from Gold srl.
Terms of Sale
This document sets out the general terms and conditions of sale and online payment via the website corresponding to the domain name www.goldboutique.it, owned and operated by Gold srl, with registered office at Via Vitruvio 296, Formia (LT), VAT number and Tax Code IT02777970597, registered with the Companies Register of Latina (LT) under number REA LT 198611. Except for any exceptions specifically agreed in writing, these general terms and conditions govern the relationship between Gold srl and the customer, whether a consumer or a professional.
EXERCISING THE RIGHT OF WITHDRAWAL
The Customer has the right to withdraw from the contract within 14 days of receiving the products, without giving any reason, pursuant to Legislative Decree 206/2005 (Consumer Code) and EU Directive 2023/2673.
How to exercise the right of withdrawal
The Customer may exercise the right of withdrawal through one of the following methods:
- Online withdrawal function — by accessing their personal account area at account. To log in, simply enter your email address: an OTP code will be sent allowing access without the need for registration. Once logged in, the Customer can view their orders and:
- If the order has not yet been shipped: it can be cancelled directly from the order area. The Customer will receive an automatic confirmation of the cancellation with date and time.
- If the order has already been shipped: a return can be requested by filling in the relevant form. In this case, the store's policies apply; return shipping costs are borne by the Customer.
- Written statement — by sending an explicit notice of withdrawal by email to info@goldboutique.it, indicating first name, last name and order number.
- Standard withdrawal form — by completing and sending the standard form provided for under European regulations.
Payments
The following payment methods are offered in our store:
Bank transfer — If bank transfer is chosen as the payment method, we will provide our bank details when the order is confirmed, and the goods will only be shipped once payment has been received.
PayPal / Credit cards — After submitting the order with this payment method, you will be transferred to the PayPal website (the online payments provider).
On the PayPal site you can choose between 2 payment options:
- Credit card — you can pay for your order with credit or prepaid cards from the major international networks such as Visa, Mastercard, PostePay and American Express, directly and without any obligation to register with PayPal.
- Pay with PayPal — in this case you must already be, or newly register as, a PayPal member, log in with your credentials and confirm the payment.
After submitting the order, you will receive further instructions during the order process.
Conclusion of the Contract
Once payment has been made, the purchase order is taken in charge by goldboutique.it, which will send a confirmation-only email stating that the order has been received. After verifying the correctness of the payment and of the personal and shipping details, and checking the availability of the ordered product, goldboutique.it will consider the contract concluded and will confirm the order's fulfilment by email with all relevant information. Please note that goldboutique.it may cancel purchase orders that do not provide sufficient guarantee of solvency, that are incomplete or incorrect, or in the event that products are unavailable. In such cases, the user is notified by email that the contract has not been concluded and that goldboutique.it has not proceeded with the order. In particular, in the case of products that are no longer available, or that were available at the time of the last visit to the site (i.e. when the order form was submitted) but subsequently became unavailable, goldboutique.it will promptly notify the customer — and in any event within thirty (30) days from the day after the order was submitted — of the unavailability of the ordered products. Where a contract is not concluded but payment has nonetheless been made, goldboutique.it will refund without delay whatever amount the user has already paid.
Right of Withdrawal
You have the right to withdraw from this contract, without giving any reason, within 14 days.
The withdrawal period will expire 14 days from the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the last item of goods.
The security tag present on items to be returned must not be cut or broken.
To exercise the right of withdrawal, you must inform us (Gold s.r.l., Via Vitruvio, 296 – Formia (LT) – 04023 – Tel.: +39 0771 324687 – Email: info@goldboutique.it) of your decision to withdraw from this contract by means of an unequivocal statement (e.g. a letter sent by post, fax or email). You may use the attached model withdrawal form, but this is not mandatory.
Effects of Withdrawal
If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (except for the additional costs arising from your choice of a delivery type other than the least expensive standard delivery offered by us), without undue delay and in any case no later than 14 days from the day on which we are informed of your decision to withdraw from this contract. Such reimbursements will be made using the same means of payment you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any costs as a result of such reimbursement. The reimbursement may be withheld until we have received the goods back, or until you have supplied evidence of having returned the goods, whichever is earlier.
Please return or hand over the goods to us at: Gold s.r.l., Via Vitruvio, 296 – Formia (LT) – 04023 – Tel.: +39 0771 324687 – Email: info@goldboutique.it, without undue delay and in any event within 14 days from the day on which you communicated your withdrawal from this contract. The deadline is met if you send back the goods before the 14-day period has expired.
You will bear the direct cost (e.g. shipping costs) of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Warranties and Product Authenticity
All products sold via the site are covered by the manufacturer's warranty against defects of conformity, for a period of 12 months where the customer is a business operator (i.e. holds a VAT number), and for 24 months where the customer is a consumer, as provided for under Legislative Decree No. 206/2005. The manufacturer's warranty is provided in accordance with the terms of the law. The warranty applies to a product that shows a defect of conformity, provided that the product has been used correctly, in line with its intended use and with the accompanying documentation. In the event of a defect of conformity, Gold srl will, at no cost to the customer, restore the product's conformity through repair/replacement, or will reduce the price, or terminate the contract. If, following inspection by Gold srl, the fault does not turn out to be a defect of conformity, the customer will be charged for any inspection and restoration costs, where applicable, as well as any transport costs incurred by Gold srl. Should Gold srl, for any reason, be unable to return a product under warranty to its customer (repaired or replaced), it may, at its discretion, either refund the amount paid — taking into account use of the product — or replace it with a product of equal or superior characteristics. Repair or replacement times for a defective product depend exclusively on the manufacturer's policies, and no damages may be claimed against Gold srl for any delays in carrying out repairs or replacements. Where the application of the warranty requires the return of the product, the customer must return it in its original packaging, complete in all its parts (including packaging and any documentation and accessories). To limit damage to the original packaging, Gold srl recommends placing it inside a second box.
Promotional Codes
Customers who subscribe to Gold srl's newsletter will receive information on the products and brands featured in the catalogue, images and previews of events and fashion shows, updates on promotions, and promotional codes. Promotional codes received by email are strictly personal and non-transferable. Every promotional code has, by nature, a validity period, and this time limit cannot be extended in any way; in some cases, promotional codes are valid exclusively for certain brands or items, as specified in the email containing the code. Promotional codes cannot be combined with one another, transferred and/or sold. Gold srl reserves the right to refuse orders placed using promotional codes that show signs of duplication or fraudulent use.
Sizes and Fit
Sizing varies considerably from designer to designer. For this reason, each product page includes the following information: • A link to the "Size Chart," where you can convert international sizes, find guidance on product measurements, a usage guide, and further information on how garments fit and whether they run particularly tight or loose. Protection of Personal Data
Pursuant to Article 13 of Legislative Decree 196/2003, as subsequently amended and supplemented, Gold srl, as Data Controller, informs the customer that personal data provided by them and collected at the time of registration in the site's restricted access area, upon conclusion of an online purchase contract for any product, or while browsing the site through so-called system "logs," will be processed by manual, IT and telematic means for the following purposes:
a) Carrying out the activities necessary for Gold srl to conclude, manage and perform product purchase contracts via its own site;
b) Purposes strictly connected to and/or necessary for satisfying requests made from time to time by the user via the site, by email, or through other means of communication;
c) Fulfilling obligations under laws, regulations and EU legislation, as well as directions issued by authorities legally empowered to do so, or by supervisory and control bodies;
d) Sending newsletters and promotional material relating to the products offered by Gold srl.
With regard to the purposes indicated above, Gold srl states that providing data is mandatory for purposes a), b) and c), with the consequence that any refusal to provide such data will make it impossible for Gold srl to fulfil the customer's orders or requests.
In light of the above, with regard to the processing referred to in point d), Gold srl will ask the customer, from time to time, via dedicated fields on the site, to give consent to that type of processing. Personal data is processed using methods strictly related to the purposes described above and, in any case, in a manner that ensures the security and confidentiality of the data. Furthermore, personal data may be disclosed — for the purposes referred to in points a), b) and c) — to parties other than Gold srl, who will process it as independent data controllers or as data processors. In any case, personal data will not be disseminated. Gold srl further informs the customer that Article 7 of Legislative Decree 196/2003 grants customers who provide their personal data specific rights, including the right to obtain from the data controller or processor, where designated, confirmation as to whether or not their personal data exists, and to have such data made available in an intelligible form; to know the origin of the data as well as the logic and purposes on which the processing is based; to obtain the erasure, anonymization or blocking of data processed in violation of the law, as well as the updating, rectification, or — where there is an interest — the supplementation of the data; and to object, on legitimate grounds, to the processing itself. In order to stay informed of any breaches or changes to the personal data protection policies followed by Gold srl — mainly due to regulatory changes — the customer is advised to regularly consult this document.

Italian Law
Users accessing this site declare that they accept that all matters relating to the use of the Gold Boutique website are governed by the laws in force in Italy. Gold does not in any way guarantee that the site's content complies with the regulations in force in other countries. Access to the Gold srl site from places where its content is considered illegal is expressly prohibited. Users who choose to access the site from such countries are fully aware of the legal consequences and penalties they may incur, and will be solely responsible for compliance with local laws.
Acceptance
Pursuant to and for the purposes of Articles 1341 and 1342 of the Italian Civil Code, the undersigned declares to expressly accept the provisions set out in the following articles: 3 (summary description of the products in the catalogue); 5 (right not to fulfil the order); 8.1, letter E (no liability for the fraudulent use of the customer's credit cards); 8.1, letter F (no liability for the successful completion of online payment); 8.2, letter B (right to cancel the order if a copy of the bank transfer is not received within 48 hours); 8.3, letter B (right to cancel the order in the case of payment from unverified PayPal accounts); 11 and 22 (delivery/shipping costs and taxes borne by the customer); 15 (fulfilment of Gold srl's obligations upon delivery of the product to the chosen carrier); 16 (customer's obligation to inspect the delivered products); 17 (acceptance of the product without reservation by the customer, in the absence of any objection); 32 (privacy) and 34 (applicable law) of these General Terms and Conditions.
